Terms of Service

1. Acceptance of Terms

By accessing or using the Argentoverse platform, website, applications, and related services (collectively, the "Services") operated by Argento Simulations LLC ("we," "our," or "us"), a company registered in Austin, Texas, United States, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you must have parental or guardian consent. By creating an account, you represent that you meet these age requirements.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to require a registration key for account creation.
  • One account per person. Creating multiple accounts may result in suspension.

4. User Conduct

When using our Services, you agree not to:

  • Harass, bully, threaten, or intimidate other users
  • Post or transmit content that is illegal, harmful, abusive, defamatory, or obscene
  • Impersonate any person or entity
  • Use cheats, exploits, bots, or unauthorized third-party software
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Services or servers
  • Engage in real-money trading (RMT) of in-game items or currency outside of official channels
  • Manipulate the marketplace through price fixing, wash trading, or market manipulation
  • Share, sell, or transfer your account to another person
  • Use the Services for any commercial purpose without our prior written consent

5. Virtual Items and Currency

  • Virtual items, currency, and in-game assets are licensed to you, not sold. You do not own them.
  • We reserve the right to modify, remove, or rebalance virtual items at any time for game health.
  • Virtual items and currency have no real-world monetary value and cannot be exchanged for real currency.
  • Trades and marketplace transactions between players are final once completed.
  • We are not responsible for losses resulting from player-to-player trades.

6. Purchases and Payments

  • All purchases are processed through Stripe and are subject to Stripe's terms of service.
  • Prices are listed in USD unless otherwise specified.
  • Subscriptions renew automatically until cancelled. You may cancel at any time through your account settings.
  • Refunds are handled on a case-by-case basis. Contact support for refund requests.
  • We reserve the right to change pricing at any time, with notice for active subscriptions.

7. User Content

You retain ownership of content you create (housing designs, chat messages, marketplace listings). By posting content through our Services, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content within the Services.

You are solely responsible for your content. We may remove content that violates these Terms or our community guidelines.

8. Moderation and Enforcement

We reserve the right to:

  • Warn users for minor violations
  • Mute users from chat channels (temporary or permanent)
  • Suspend users from specific features (chat, trading, social) or entirely
  • Freeze trading privileges for suspicious activity
  • Terminate accounts for severe or repeated violations

Moderation actions are at our sole discretion. You may appeal actions through the support ticket system.

9. Intellectual Property

All content, graphics, code, design, and trademarks associated with Argentoverse are the property of Argento Simulations LLC or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Third-Party Services

Our Services integrate with third-party providers including:

  • Amazon Web Services (AWS): Cloud infrastructure and authentication (Cognito)
  • Stripe: Payment processing

Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARGENTO SIMULATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Argento Simulations LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Services, violation of these Terms, or infringement of any rights of a third party.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Texas.

15. Dispute Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at service@argentosims.com. If a dispute cannot be resolved informally within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association (AAA) in the State of Texas.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Termination

We may suspend or terminate your account at any time for violations of these Terms. You may terminate your account at any time through the Security settings page. Upon termination, your license to use the Services ceases, but provisions that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) will remain in effect.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Services or via email. Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.
